Son of Housewives Star’s Sex Crimes Case EXPLODES

Son of Housewives Star’s Sex Crimes Case EXPLODES

KJ Biermann, the 15-year-old son of former Real Housewives of Atlanta star Kim Zolciak, is currently being held in a Fulton County detention center facing seven felony sexual crime charges. The allegations stem from an incident involving a 15-year-old female classmate at a gym sauna. Prosecutors intend to try KJ as an adult, a move that could result in decades behind bars. Read the full breakdown below.

1. The Allegations and the "Missing DNA" Defense

The incident allegedly occurred on April 23rd at a Lifetime Fitness Center in Alpharetta, Georgia, when KJ was 14. According to the police affidavit, KJ and the female classmate were walking through a family changing room toward a co-ed sauna when he allegedly forced her to perform a sexual act on him, despite her repeatedly telling him no and swatting his hands away.

However, KJ’s defense attorney, Jason Sheffield, is pointing to a massive potential hole in the prosecution's case: the police report notes that investigators found absolutely no male DNA on or inside the areas where the alleged victim claimed she was assaulted. Sheffield insists KJ is "100% innocent" and claims to have evidence that the accuser has a history of making prior false allegations.

2. Trying a 15-Year-Old as an Adult

Prosecutors are moving to try KJ as an adult rather than in the juvenile system. Former prosecutor and law professor Marian Bracha explains that in Georgia, certain severe crimes are colloquially known as the "Seven Deadly Sins," which include aggravated child molestation and aggravated sexual battery (two of the charges KJ faces). Because he is charged with these specific offenses, the adult superior court automatically has jurisdiction over his case, despite his age.

KJ's legal team recently filed an emergency motion to transfer the case back to juvenile court. Bracha notes the stakes are incredibly high: in juvenile court, there is no right to a jury trial, but punishments often focus on probation or supervised release, and records can easily be sealed or expunged. If convicted in adult court, KJ faces decades in prison, and the felony conviction would attach permanently to his adult criminal record.

3. The Cross-Examination Strategy and "Rape Shield" Laws

Host Jesse Weber asked how a defense attorney goes about cross-examining a 15-year-old alleged victim in a sensitive sexual assault case, especially when the defense plans to introduce evidence of "prior false allegations."

Bracha anticipates that the prosecution will file a motion invoking Georgia's "Rape Shield" laws to protect the alleged victim's sexual history from being discussed in open court. The defense's likely response will be that they are not inquiring about her sexual past, but rather her history of dishonesty. If a judge allows it, this could be devastating to the prosecution's case, as sexual assault cases often hinge entirely on the credibility of the complaining witness versus the defendant's right to remain silent.
